Customer(s), on availing the travel services offered at www.aviatefly.com: a website by “Travel Avatar Inc” accept the following:

That, Customer has called the phone number of www.aviatefly.com, a website by Travel Avatar Inc, for their travel service requirements.

That, Customer has made flight booking(s), as detailed to them, through www.aviatefly.com, a website by “Travel Avatar Inc”, and they authorize www.aviatefly.com, a website by Travel Avatar Inc and/or its consolidator(s), to charge their debit/credit card, as detailed by them, for the amount accepted by them, as quoted by “Travel reservation experts” of “Travel Avatar Inc”.

Customer understands that, there will be one or more than one charges on their Credit / Debit card, together it equals to the amount accepted by them.

Customer accepts, on his reply email and / or SMS and / or on recorded phone line the following details:

  • Their Debit / Credit Card details i.e. Number, Issuing Bank Name, Issuer:
    Master/Visa/American Express/Discover, Name as on card, Valid through, billing address and security code.
  • The booking reference number (PNR), passenger details and the travel itinerary, as detailed to them.

WARRANTY:Customer warrant that he/ she is at least 18 Years of age and possess the legal authority to enter into this agreement and to use the DEBIT/CREDIT Cardin accordance with all Terms & Conditions herein. If they are making travel reservations or bookings for another person(s),they agree to inform that person(s) about the Terms & Conditions that apply to the travel reservations and bookings that they have made on their behalf, including all rules and restrictions applicable thereto and these Terms & Conditions. They agree to be financially responsible for all of the use of Debit/Credit Card. They are responsible for any bookings and travel reservations made by persons under their direction or control. They also warrant that all information supplied by them or on their behalf, or by members of their household in using the Debit/Credit card is true, current, complete and accurate. Furthermore, they also confirm that the traveler is not an unaccompanied minor. They know that without limitation, any exploratory, speculative, false, or fraudulent reservation or any reservation in anticipation of demand is prohibited.

ITINERARY CONFIRMATION: It is the customer’s responsibility to review and reconfirm names, dates, flight numbers, airlines and routing including all airport changes. If they discover any discrepancy in the itinerary, they will immediately contact www.aviatefly.com, a website by Travel Avatar Inc, within four hours from the time booking was completed. If they fail to contact www.aviatefly.com, a website by Travel Avatar Inc, by phone within four hours of completing the booking, then they shall consider the booking, which they have made, to be acceptable to them and they will not assume any liability thereafter for any discrepancy in their booking. They have reviewed and saved the itinerary.

NAME CHANGE: Customers are aware that most of the airlines do not allow any date or name changes after the booking is completed. However date change can be done as per terms and conditions of the Airlines after paying the charges, which are different for every airline.

CANCEL AND EXCHANGE:Customers are aware that most of the airline tickets are 100% non-refundable. In certain cases, where the airline may allow cancellations, a credit may be given towards a future ticket purchase by the same traveler on the same airline. Usually, the credit note issued by the airline has a specific expiration date, after which it cannot be used. They will make themselves aware about the additional restrictions attached to such a credit. They are also aware that all such bookings where the cancellation may be permitted must be cancelled prior to the scheduled departure time of the first flight segment. They know that www.aviatefly.com of Travel Avatar Inc does not guarantee any cancellation. When they are ready to make their new booking and wish to use their airline credit, they will be required to pay the fare difference (if any), applicable airline penalties and any applicable post-ticketing fees of www.aviatefly.com, a website by Travel Avatar Inc. They know that all such changes are governed by each airline’s fare rules, policies and procedures, which are not under the control of www.aviatefly.com/Travel Avatar Inc and they will assist the customer in locating their desired new available flights and attempt to re-book the new flights based on availability and other factors.

ACCEPTANCE/REJECTION OF CUSTOMERS PAYMENT: If customer’s credit/debit card or other form of payment is not processed or accepted for any reason, they may expect www.aviatefly.com/ Travel Avatar Inc to notify them within 24 hours (it may take longer than 24 hours for non credit/debit card payment methods). Prior to these form of payment being processed and accepted successfully, if there is a change in the price of air fare or any other change, customer may be notified of this change and only upon such notification, they have the right to either accept or decline this transaction. If they elect to decline this transaction, they will not be charged.

POST-TICKETING SERVICE FEES: Customers are aware that cancellation within four Hours of booking is Free of Charge. Cancellation after four hours of booking is subject to the respective airline(s) cancellation policy.

CREDIT/DEBIT CARD PAYMENT: Customer’s know that all Debit/Credit cards must have a verifiable US or Canadian billing address. All bookings and fares are not guaranteed until ticketed by the supplier. When they authorize their credit or debit card for a purchase, www.theflydeals.com/Travel Avatar Inc may request for an authorization for the amount of their anticipated transaction (placing a temporary “hold” on the funds). If for some reason www.aviatefly.com/Travel Avatar Inc are unable to confirm their booking, they will not be charged and www.aviatefly.com/Travel Avatar Inc will request that such hold be released by your credit or debit card bank. Until then, the funds are subject to hold and will not be available for their other purposes.

If the customer’s Credit/Debit card is declined for any reason, they may expect www.aviatefly.com/Travel Avatar Inc to notify them within seventy-two hours. The customer is aware that simply submitting the Debit/Credit card does not automatically guarantee ticketing. The customer is aware thatwww.aviatefly.com of Travel Avatar Inc will not be held responsible in the event that their credit or debit card is not approved or charged. There can be many reasons why the credit or debit card may not be approved or charged. Examples of these maybe: airline could not confirm the booking, fare increased since payment information was submitted and prior to ticketing; or sufficient funds are not available on the Debit/Credit card. In such instances where the fare may have increased, the customer may expect www.aviatefly.com/Travel Avatar Inc to provide them with alternate options and the customer has the right to cancel the booking at no cost. The customer is fully aware that when the booking is ticketed at the cost originally quoted to them, the ticket becomes non-refundable and non-cancellable.
The customer can expect www.aviatefly.com of Travel Avatar Inc to use stringent safety measures for credit card payment processing. Fraudulent transactions, if any, should be reported to airport security, airlines and other federal and state law enforcement agencies. The customer agrees to be liable for any and all credit card payments and agrees not to dispute charges after the purchase has been made and the tickets and/or other products have been delivered by email confirmation or have been shipped to them. The customer agrees to reimburse www.aviatefly.com/Travel Avatar Inc in cases of charge-back or Credit/Debit card disputes where they have genuinely purchased a service from www.aviatefly.com/Travel Avatar Inc. The customer knows that all Debit/Credit card transactions over the phone with the Customer Service Department are recorded and are available as evidence in case of any dispute. The customer is fully aware that when certain transactions are determined to be high risk by www.aviatefly.com/Travel Avatar Inc, the company will not process such transactions unless their credit card verification team has determined that it’s safe to process them. In order to establish validity of such transactions, they may contact the customer or their bank or the Debit/Credit card issuer.

CREDIT CARD DECLINES: The customer is aware that if their Credit/Debit card is declined at the time of processing my transaction, they may expect www.aviatefly.com of Travel Avatar Inc to notify them by email or phone within 48 hours. The customer is aware that the transaction will not be processed if their Debit/Credit card has been declined. The customer knows that the fare and any other booking details are not guaranteed. If there is a fare change, the customer has a right to cancel the booking at no cost.

SEATS, MEALS AND OTHER SPECIAL REQUESTS: The customer is fully aware that their seat(s), meal(s) and other special requests are requests only. The airline reserves the right to apply any revisions to the requested seat allocation without notification. The customer knows that all requests should be verified with the airline. The customer is aware that www.aviatefly.com/Travel Avatar Inc cannot guarantee them the assigned the seat(s) that they may have requested. The company also cannot guarantee that the customer’s meal and other special requests will be confirmed by the airline. The customer is aware that they must contact the airline directly to confirm these requests.

BAGGAGE POLICY AND FEES: The customer knows that if they have excess baggage, they will have to pay the excess baggage fee assessed by the airline. Most airlines now-a-days charge baggage fees even for the first bag checked-in and some even charge for the carry-in baggage beyond certain weight. These fees are to be paid directly to airline upon using such service. The customer shall contact the airline directly for the latest fees on check and carry-in baggage and their policy as it relates to the baggage.

UNACCOMPANIED MINOR:The customer knows that www.aviatefly.com/Travel Avatar Inc book tickets for unaccompanied minors but they don’t sell directly to unaccompanied minors age 18 and under. Each airline sets its own policies and regulations for children traveling without adult supervision. They customer must check with the airline directly for minor age requirements, as the following items may change: Some airlines may not allow unaccompanied minors to travel. Some airlines will only allow unaccompanied minors to travel on non-stop flights. Many airlines may require additional fees to be paid at check-in. The customer must call the airline to verify rules and restrictions for unaccompanied minor(s).

VISA AND ENTRY REQUIREMENTS: The customer is very well aware that they need to verify travel documents (transit visa/entry visa) for the country through which they are transiting and/or entering. Information regarding international travel can be found at www.travel.state.gov and also with the consulate/embassy of the country(s) they are visiting or transiting through www.aviatefly.com/Travel Avatar Inc will not be responsible if proper travel documents are not available with the customers and they are denied entry or transit into a country.
The customer is fully aware that their transaction with www.aviatefly.com/Travel Avatar Inc does not guarantee entrance to the country of destination. The customer also understands that www.aviatefly.com/Travel Avatar Inc accepts no responsibility for determining passenger’s eligibility to enter or transit through any specific country. Visa conformation, if any, given by www.aviatefly.com/Travel Avatar Inc (without any responsibility) must be verified with government authorities.

RE-CONFIRMATION: The customer is aware that all flights should be confirmed with the airline directly as they may have last minute schedule changes. The customer must re-confirm at least 24 hours prior to departure for domestic flights and 72 hours prior to flights to Hawaii and international destinations.

HUMAN ERROR: The customer understands that if any of the agents of www.theflydeals.com/Travel Avatar Inc makes a mistake in the booking process, they shall make reasonable attempts to rectify that error at the time of booking. If the error is not noted and corrected at the time of booking then it is the customer’s duty to notify www.theflydeals.com/Travel Avatar Inc of error within 24 hours of receiving the itinerary. Beyond this 24-hour period, www.aviatefly.com/Travel Avatar Inc will not be responsible for that error.

CHARGE-BACKS and CREDIT CARD DISPUTES: The total amount charged to the customer’s Debit/Credit card may appear as two separate charges: one charge by the airline (or consolidator) for the bulk airfare and one charge by www.aviatefly.com/Travel Avatar Inc. However, the total amount charged to the customer’s credit card (sum of these separate charges) cannot exceed the total amount agreed upon between the customer and one of the agents of www.aviatefly.com/Travel Avatar Inc. By agreeing to these terms and conditions, the customer assumes the burden of proof if they wish to contest a charge on the Debit/Credit card for the travel services purchased as outlined to them during the booking process. The customer also agrees that their bank will not be permitted to make a charge-back against www.aviatefly.com/Travel Avatar Inc, or the consolidator or the airline, until www.aviatefly.com/Travel Avatar Inc and the bank discuss the charges and the burden of proof is met. The customer also agrees not to initiate a charge-back if www.aviatefly.com/Travel Avatar Inc has abided by the terms and conditions outlined in this document. The customer also agrees that in the event they initiate a chargeback which later on proves to be unjustified or frivolous, then they are liable in full for any and all reasonable expenses incurred by www.aviatefly.com/Travel Avatar Inc in recovering the charges (including fees charged by debt recovery specialists or costs of any civil proceeding) or an administration fee of $50 whichever is greater.

The customer is fully aware that should they initiate a charge-back on the consolidator/airline for reservations, the consolidator/airline would not normally refund according to their own policies and regulations and thus the consolidator/airline passes this charge on to www.aviatefly.com/ Travel Avatar Inc or one of its fulfilment partners. In that case, the customer agrees to refund that charge to www.aviatefly.com/ Travel Avatar Inc for the same amount plus a penalty of 50% (inconvenience compensation), as well as reasonable legal fees spent to initiate proper civil proceedings (such as small claims court) to recoup this loss.
